Practice Area 04 · Better Talent

Build the team.
Not just the company.

The people running your business tomorrow are going to be better than the people running it today, because you built the architecture that attracts, develops, and keeps them.

Nine programs across culture, acquisition, and development. Designed for owners who are ready to stop competing on payroll and start competing on the strength of the team they build.

01 The Talent Pain

You can’t hire your way out of a talent architecture problem.

Most owners think they have a hiring problem. What they actually have is a talent architecture problem. Here’s how the pain shows up.

“I can’t find people who care about the work the way we do.”

“I’ve been trying to fill this position for six months.”

“My best people just left for a competitor.”

“Every hire feels like a coin flip.”

“I don’t know how to develop my next generation of leaders.”

“The people I have aren’t the people I need for where we’re going.”

02 What Actually Fixes This

Talent is not a hiring problem. It’s a systems problem.

The best hires do not come from a better recruiter. They come from a business that is designed to attract them, filter them, develop them, and keep them. Recruiting is the last twenty percent of the talent problem. The other eighty percent is the architecture around it.

A real talent system has three layers. Culture and foundation is what makes the right people want to work for you and the wrong people self-select out. Talent acquisition is the specific systems that turn open positions into qualified hires without burning six months and three recruiter fees per seat. Development and retention is how you turn the right hire into your future leadership team, and how you keep them from leaving for a competitor two years in.

Focus Efforts builds all three layers together, so the business genuinely attracts and keeps the people who will run it better than you run it now.

The businesses that scale profitably are the businesses where the owner is not the smartest person in the room by year five. That takes architecture. It does not happen accidentally.

03 Nine Programs, Three Layers

The complete talent architecture.

Grouped into three categories that build on each other: the culture foundation that makes people want to be here, the acquisition systems that get them here, and the development and retention work that keeps them here and grows them into leaders.

04 Talent Specialists on the Bench

The depth that turns talent into architecture.

Talent engagements are delivered by our internal team plus vetted specialists from the Focus360™ Professional Network. Executive recruiters, coaches, HR strategists, and leadership development experts brought in when their specific expertise is required.

No single consultant has depth across all six talent disciplines: culture design, compensation architecture, executive search, hiring systems, leadership development, and performance management. Real talent transformation requires the right specialist at the right moment, not a generalist trying to cover every discipline.

The bench brings that depth. Every talent engagement is structured around your specific situation, with specialists brought in as their expertise is needed.

Executive Search Specialists

Senior operators recruiting senior operators. Retained search for CFO, COO, VP Operations, and other senior leadership roles across the property services vertical.

Executive Coaches

One-on-one coaching for founders, executives, and high-potential leaders. Structured development programs, not just conversations.

Compensation & Benefits Strategists

Comp architecture specialists who understand what SMB owners can actually afford and how to structure incentives that retain the right people.

Culture & Values Consultants

Specialists in translating cultural intent into operational practice. Not workshop consultants. People who help you make culture visible in how decisions get made day to day.

HR Systems & Compliance Experts

Fractional HR leadership and compliance specialists for firms too big for the owner to run HR but too small for a full-time HR head.

Leadership Development Facilitators

Trainers and program designers who build multi-quarter leadership development programs for your emerging leaders. Structured curriculum, not one-off workshops.

Employment Litigation & Legal Defense

Bench access to employment attorneys for wrongful termination defense, discrimination claims, wage-and-hour disputes, and unemployment appeals when they arise. Get real legal defense before the DOL or EEOC letter becomes a lawsuit.

HR Compliance & Employment Law Specialists

Classification audits, employee handbook development, FLSA compliance, EEOC reporting, and the ongoing employment law landscape most SMB owners can’t track alone. Compliance built proactively, not fixed after the fact.

05 The Classification Question

1099 vs W-2: what the IRS actually looks at.

Property services owners lean on 1099 classification because it’s cheaper. No employer tax. No benefits. No unemployment. No workers’ comp. But the IRS applies a specific test, and misclassification exposes the business to back taxes, penalties, interest, litigation, and sometimes criminal liability. When a reclassification hits, the assessment goes back years.

The question is not what you called the worker on the paperwork. The question is what the facts of the relationship say. Issuing a 1099 does not make someone a contractor if the facts of the relationship match an employee. And the IRS reclassifies based on facts, not paperwork.

The Test the IRS Actually Applies

The IRS Three-Prong Test.

When the IRS or a state agency evaluates whether a worker is an employee or a contractor, they do not look at the paperwork. They look at the relationship across three dimensions. If the relationship looks like employment on any dimension, the classification is at risk.

01

Behavioral Control

Does the business control what the worker does and how they do it? Instructions, training, evaluation systems, and required work hours all fall under behavioral control.

02

Financial Control

Are the business aspects of the worker’s job controlled by the payer? How is the worker paid, expenses reimbursed, tools and supplies provided? Financial control matters.

03

Type of Relationship

Are there written contracts? Employee-type benefits? Continuing relationship? Is the work performed a key aspect of the business? The nature of the relationship counts.

The traps that catch owners after the fact

The IRS reclassifies based on facts, not paperwork.

Owners often think they’re safe because they issued a 1099 and had the worker sign a contractor agreement. Then a former contractor files for unemployment or workers’ comp, and the state agency reclassifies based on the actual facts of the relationship. Common triggers, even long after the job is finished:

  • The ex-contractor drove a company vehicle
  • The ex-contractor was invited to company parties, retreats, or holiday events
  • The ex-contractor used company tools, uniforms, or branded materials
  • The ex-contractor was paid weekly or biweekly, not by deliverable
  • The ex-contractor was paid an hourly rate, not by project
  • The ex-contractor could not work for other companies (exclusivity)
  • The ex-contractor had a company email address
  • The ex-contractor was listed on the company org chart
  • The ex-contractor was subject to company policies and procedures
  • The ex-contractor was terminated rather than the contract being ended
What Focus Efforts delivers

Proactive classification audit and defensible restructuring.

Our bench includes five employment attorneys and a former IRS auditor who is also a CPA. That combined depth is what turns a classification audit from a general opinion into a defensible position. We audit your workforce, identify the workers at risk, and design the transition path. Some workers get properly transitioned to W-2 with the right structure. Some contractor relationships get restructured to actually pass the three-prong test. Done proactively, this saves seven figures over the life of a business. Done reactively, after the DOL letter arrives, it costs multiples of what proactive work would have.

Misclassification is not something you get to fix retroactively when the audit letter arrives. The exposure builds every quarter you keep the wrong worker in the wrong bucket.

06 Day Labor Resources

Day labor providers for property services.

When you need surge capacity for storm response, restoration crews, event staffing, or project spikes, day labor and temp staffing agencies solve the problem without the classification risk of managing your own contractors. The agency is the employer of record, which means the W-2 and workers’ comp obligations sit with them.

These are the day labor and temporary staffing providers that consistently show up in property services work. Some are best for skilled trades. Some are best for general labor. Some specialize in disaster restoration. The right choice depends on your specific situation, geography, and the work you need done.

This resource list is provided as-is. Focus Efforts does not endorse any specific provider and does not receive compensation from any listed company. Providers listed alphabetically. Verify current pricing, coverage, and terms directly with each provider.

08 Focus Efforts vs. Traditional Talent Consulting

The difference between filling seats and building architecture.

Traditional talent consulting sells you seats or workshops. We build the talent architecture that turns hiring from a coin flip into a repeatable system.

Traditional talent consulting

  • —
A recruiter who wants to fill the seat Interested in the placement fee, not whether the hire actually works out. Once the person starts, the recruiter has moved on to the next commission.
  • —
An HR consultant who does compliance Handbooks, policies, and compliance work. Necessary. Not the same thing as talent strategy. Talent strategy is not their discipline.
  • —
A culture consultant who does workshops Off-sites, personality tests, and inspirational sessions. Everyone feels good for a week. Nothing changes in how the business actually operates.
  • —
No accountability for outcomes Deliverable is a report or a placement. What happens next in the business is somebody else’s problem.

What Focus Efforts builds

  • ✓
Talent architecture that runs Culture, acquisition, and development working together. Not recruitment for its own sake. Real infrastructure that produces the team you need at every stage.
  • ✓
Named specialists on the bench Executive search, coaching, comp strategy, and leadership development delivered by specialists with real depth in each discipline. Not generalists doing all of it.
  • ✓
Culture that operates day to day Values translated into how decisions get made, how meetings run, how promotions happen. Not workshops. Operational practice.
  • ✓
Ongoing accountability Monthly Engagement means we adjust the talent architecture as your business grows. F.O.C.U.S.+ quarterly reviews include talent as a primary lens.
09 How to Start

The first conversation is diagnostic.

You don’t need to know which of the nine programs is right for you. That’s what the first conversation is designed to figure out.

Step 01

15-minute conversation

Book a call. Tell us what’s happening on the talent side right now. Who you’re trying to hire, who you’re trying to keep, what feels broken. We give you an honest read on the fit.

Step 02

Talent assessment

If we’re a fit, we run a comprehensive talent assessment. Where the architecture gaps are. Which of the nine programs would deliver the highest impact for where your business is going.

Step 03

Designed engagement

Custom engagement combining the right programs across culture, acquisition, and development. Named bench specialists lined up before we start. Clear milestones. Measurable outcomes.

The Practice Area Behind the Work

The team you’ll build is the business you’ll eventually sell.

Every program in this practice area is designed to move you from an owner-dependent business to an owner-optional business. Better hires. Better culture. Better development. Better retention. Better leadership.

The businesses that scale profitably are the businesses where the owner is not the smartest person in the room by year five. That takes architecture. It does not happen accidentally. The years start when you decide they do.
